GEM CHASE – TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using the Gem Chase mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Gem Chase provides data analytics and market insights for the trading card industry. All lists and rankings, including "Gem Chase" and "Mint Yield," are generated via proprietary algorithms based on historical market data. We reserve the right to update, modify, or remove data and features at any time to maintain the quality of the service.

3. Not Financial Advice

Gem Chase is a data tool provided for informational purposes only.

• We are not financial advisors, investment advisors, or professional card graders.
• All profit simulations, "Whale Scores," and data points are estimates based on past performance and do not constitute recommendations to buy, sell, or grade any specific asset.
• Trading cards are volatile assets. All financial decisions are made at your own risk, and Gem Chase is not responsible for any losses incurred.

4. Subscriptions & Payments

Gem Chase offers premium features via a "Pro Subscription."

• Service Provider: We use RevenueCat to manage subscription logic and entitlement tracking.
• Billing: All payments are processed through the Apple App Store. By purchasing a subscription, you agree to Apple’s standard billing terms.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Cancellations: You can manage or cancel your subscription at any time through your Apple ID Account Settings.
• Refunds: Because all payments are handled by Apple, Gem Chase cannot personally issue refunds. All refund requests must be directed to Apple Support.

5. Intellectual Property

The App’s interface, proprietary grading algorithms, and original content are the exclusive property of Gem Chase. You are granted a limited, non-exclusive license to use the data for personal, non-commercial use. Scraping, copying, or redistributing our data for commercial purposes is strictly prohibited.

6. Limitation of Liability

To the maximum extent permitted by law, Gem Chase (and its third-party data providers) shall not be liable for:

• Any financial losses resulting from market fluctuations.
• Inaccuracies in the data.
• Physical damage to cards during the grading process at third-party companies (e.g., PSA).
• Any direct, indirect, or incidental damages arising from your use of the App.

7. Disclaimer of Warranties

The App is provided on an "as-is" and "as-available" basis. We make no warranties, expressed or implied, regarding the accuracy or completeness of the data or the continuous availability of the service.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.
